Here we set out the terms and conditions that affect your booking with West Cork Experiences
No contract shall arise until West Cork Experiences has received a deposit or full payment for the tour or activity and has issued written confirmation of its acceptance to you. An internet booking is a confirmed booking once you have received a Booking Reference number in a confirmation email. The terms of the contract between the Customer and the Organiser are contained solely in this document, the Organiser’s confirmation, the Organiser’s brochure or other descriptive material, any ticket issued, the terms and conditions of any suppliers of services, and the itinerary issued by the Organiser.
Tours and experiences refer to all of the activities, events, packages and other items available for sale via westcorkexperiences.com or any West Cork Experiences materials.
It is a condition of booking that you must hold valid travel insurance for the duration of the tour or experience you have booked with us, and that the insurance policy you take out covers medical expenses and repatriation costs. You must give us details in writing of your insurer, policy number and insurance expiry date no later than the date the balance of the cost of your tour is due.
You must accept responsibity for disclosing any existing medical conditions or disabilities which may require assistance before you book your tour or experience, or, if newly diagnosed, as soon as known, before the date on which your tour or experience begins. Every effort is made to offer inclusive, accessible tours, and clear information from you will help us ensure the quality of your experience.
Tours and experiences which indicate the need for good general fitness require you to be able to walk at a reasonable speed for at least thirty minutes at a time, without aid or requiring a rest.
Your Booking Changes or Cancellations
Deposit payments paid by you to West Cork Experiences are non-transferable to other departures and non-transferable to other visitors, unless by express written permission from West Cork Experiences. If after acceptance by us, a visitor wishes to alter a holiday, we may make changes on your behalf at our discretion if practicable. We will advise you if any additional cost or refund is involved.
Once travel has commenced, no changes or alterations may be made to your oder, and no refunds shall be made in respect of travel arrangements which are not availed of.
Day Tours Only (Inc. half-day tours, events taking place on one day)
No refund will be given within 72 hours of the tour departure.
A 50% refund of the tour price will be given with proper written notice by email, 72-144 hours before the tour departure.
A full refund of the tour price will be given, 144 hours or more before the tour departure.
If you wish to make a cancellation of a multi-day scheduled tour, the following charges apply:
Within 14 days of the tour departure, no refund will be given.
Within 14-29 days before the tour departure, a 70% refund of the tour price will be given.
30-90 days or more before the tour departure, an 80% refund of the tour price will be given.
90 days or more before the tour departure, a 90% refund will be given.
Our Rights to Make Booking Changes or Cancellations
It is very unlikely that we will have to make any changes to your travel arrangements, but we reserve the right to do so at any time. Most such changes will be minor and we will advise you of them at the earliest possible date. Such changes may, for example, reflect changes in event order during your activity.
Where a minimum number of participants is required for us to run a tour or experience, we will make this clear on the booking page. If the minimum number of clients required to operate a tour is not reached, then we may cancel it. We will not cancel your travel arrangements, except for reasons of force majeure or failure by you to comply with our booking conditions (such as paying the final balance). If we are unable to provide the travel arrangements we have agreed with you, you can either have a full refund of monies paid, or we can transfer monies paid to another available tour/course (we will refund any difference if the alternative is of lower value). Please note that we do not have any responsibility of liability for any consequential loss you may incur from arrangements made with another party or parties.
No tour or experience can be cancelled or amended by you at any time on the basis of weather conditions. We accept no responsibility for weather conditions that may affect the delivery and implementation of our itinerary, though we will adjust itineraries where feasible to ensure you have a reasonable experience in the prevailing conditions.
We will ensure that the tour arrangements set out in your tour description will be delivered as part of our contract with you. We will accept responsibility if, for example, you suffer death or personal injury or your contracted tour arrangements are not provided as promised. We will also accept responsibility if we, our employees, agents, or suppliers fail to deliver your contracted tour arrangements to a reasonable standard. Please note, it is your responsibility to show that reasonable skill and care have not been used if you wish to make a claim against us.
The terms of our contract with you are to be interpreted under, and are subject to the laws of the Republic of Ireland.
West Cork Experiences will only be responsible for what our employees, agents, and suppliers do or do not do if they were acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers) at the time relevant to your complaint.
We will not be responsible for any injury, illness, death, loss (for example, loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:
* the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party
* the act(s) and/or omission(s) of a third party not connected with the provision of your tour and which were unforeseeable or unavoidable or ‘force majeure’ as defined below.
Except where otherwise expressly stated in these terms and conditions, we regret we cannot accept liability or pay any compensation where the performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss, or expense of any nature as a result of “force majeure”. Force Majuere refers to unusual and unforeseeable circumstances beyond the control of the Organiser, or other suppliers of services, the consequences of which could not have been avoided even if all due care had been exercised. It also refers to an event which the Organiser or the supplier of services, even with all due care, could not foresee or forestall, including Acts of God, natural disasters, adverse weather conditions, fire or other destruction of any vessel, craft or vehicle to be used in connection with a holiday, riots, acts of war, civil commotion, exercise of legislative, municipal, military or other authority, strikes, industrial action, requisition of equipment, mechanical breakdown, shortage of fuel, insolvency or default of any carrier or service supplier connected with a holiday, fraud perpetrated against the Organiser or any other reason beyond the control of the Organiser.
In the unlikely circumstances that you would like to make a complaint in relation to a tour or activity, you must immediately inform the Organiser’s representative at the location where the complaint arises and shall if the Organiser requires, complete a form setting out the detail of your complaint. If you fail to comply with any such requirement, the Organiser shall be entitled to recover costs from you that arise from any subsequent investigation of a complaint, which is found to be unjustified.
You shall be obliged to notify the Organiser in writing of any complaint not later than 28 days after the termination of your tour or activity, whichever is the earlier and no complaint received thereafter shall be entertained.
West Cork Experiences is committed to protecting your privacy and information. The information you provide will be used for the purposes of fulfilling our contract with you. Information that you provide will be held on West Cork Experience’s computers and cloud services (and in other forms) for use by us for the following purposes:
A copy of the personal information held by West Cork Experiences can be provided to you on request. You have the right to have any inaccurate personal information rectified or erased.
